Arizona vote on protecting abortion rights faces one last courtroom hurdle

Regarding allowing a statewide vote on upholding the state Constitution’s abortion rights, Arizona’s highest court will have the last say.

There are only a few days left till the decision.

A representative for the Maricopa County Elections Department stated that the courts have been given until August 22 to render final decisions regarding ballot initiatives. The timetable for mailing ballots to voters serving overseas and in the armed forces establishes the deadline.

The Arizona Abortion Access Act, an initiative supporting abortion rights, has received a record number of signatures, according to Secretary of State Adrian Fontes, who confirmed this earlier this week. 

Following the mandatory examination by the Secretary of State’s office and each of the 15 counties in Arizona, there were about 200,000 thousand more legitimate signatures than what was needed in order for the ballot to be eligible.

Proposition 139 is the new name for the reproductive rights initiative.

However, the Arizona Supreme Court is currently debating a matter that could prevent the initiative from being placed on the ballot.

The mandatory 200-word explanation of Proposition 139 on the ballot, according to Arizona Right-to-Life, is “inherently misleading and confusing” and “fails to inform would-be signers of the drastic changes in law.”

This week, proponents of the initiative will submit their answer to the court.

A judge on a lower court dismissed the challenge two weeks ago.

“The description fully and accurately communicated the initiative’s key provisions,” Judge Melissa Iyer Julian of Maricopa County Superior Court stated in her decision. “This Court will not order its removal from the general statewide election ballot.”
